App-based Worker Notice of Rights (Seattle)

The following outlines the Notice of Rights (“NOR”) provided by Uber Technologies, Inc. (Uber), pursuant to Sec. 8.37.100 of Seattle Bill CB 120294. This NOR is solely applicable to app-based workers, as defined by Seattle Bill CB 120294, operating in Seattle, WA.

Pursuant to Seattle Municipal Code (SMC) Section 8.37.100 of Seattle Bill CB 120294, app-Based Workers operating in Seattle have the right to:

  1. Minimum per-minute, per-mile and per-offer amounts guaranteed by Chapter 8.37, including the following:
    1. Minimum per-minute amount for engaged time: $0.45
    2. Minimum per-mile amount for engaged time: $0.77
    3. Minimum per-offer amount: $5.20
  2. Receipt of the information required to be disclosed by SMC Ch. 8.37 before accepting an offer and performing services in furtherance of an offer;
  3. Flexibility in being available to complete delivery trips, as well as whether to accept, reject, or cancel offers to complete delivery trips;
  4. Protection from retaliation for exercising in good faith the rights protected by SMC Ch. 8.37;
  5. The right to file a complaint with the Agency or bring a civil action for violation of the requirements of SMC Ch. 8.37, including but not limited to a network company’s or any person’s failure to pay the minimum per-minute amount, per-mile amount, or per-offer amount, and a network company’s or other person’s retaliation against an app-based worker or other person for engaging in an activity protected by SMC Ch. 8.37.
  6. The right to a clear statement of the network company’s tip policy, including but not limited to whether the network company’s online-enabled application or platform allows customers to tip in advance of completion of an online order and whether the network company permits customers to modify or remove tips after performance.
  7. The right to a clear statement of the network company’s fraudulent use policy pursuant to Section 8.37.090. Uber’s fraudulent use policy for Seattle can be found here
  8. The right to communicate the reason for cancellation with cause pursuant to SMC Ch. 8.37.080 (to cancel with cause you must submit the cancellation reason in the Uber app Help Center under Driving and Delivering > Trips > Cancellations.
  9. The right to access the information required pursuant to SMC Ch. 8.37.070 (B) and (C) for a period of up to three years (to request the information, you must contact Uber Customer Support at account_info_request@uber.com).
