Terms and conditions
1. Overview
- The #MyUberEatsBag (Competition) is promoted by Uber Australia Pty Ltd (ABN 49 160 299 865) (we, us or our).
- By entering the Competition, all entrants (you or your) agree to be bound by these terms and conditions (Terms) and our privacy policy. Any breach of these Terms may result in disqualification from the Competition.
- To the extent of any inconsistency between these Terms and any other reference to the Competition, these Terms prevail.
- The Competition:
- begins at 10am Australian Eastern Standard Time (AEST) on 6 July 2023; and
- ends at 11:59pm AEST on 31 August 2023,
(Promotion Period).
2. Eligibility
- This Competition is open to restaurants in Australia and New Zealand who:
- have a store account on the Uber Eats app and have completed at least 1 order via Uber Eats within the 12 months prior to the end of the Promotion Period; and
- as at the last day of the Promotion Period:
- are subscribed to the Uber Eats monthly merchant newsletter; and
- have an account registered with Detpak.
- Employees and contractors (and their Immediate Families) of Uber Australia Pty Ltd, our Related Bodies Corporate and the agencies associated with this Competition are ineligible to participate in this Competition.
3. How to enter
- The Competition is a game of chance.
- To enter the Competition, you must, during the Promotion Period, take a photo of the green Uber Eats bag whilst showcasing your business’ unique flair and post it in-feed on your business’ Instagram page using the hashtag #MyUberEatsBag.
- You can purchase a green Uber Eats bag at https://ubereats.detpak.com.
- You may enter the Competition once for each store you operate on the Uber Eats app.
- You need a store account on the Uber Eats app and Instagram to enter the Competition.
- We will not accept entries submitted after the end of the Promotion Period.
- The time and date of each entry will be the time and date displayed on the post you make on your business’ Instagram page in accordance with clause 2.1(b)(i).
- We may, at any time:
- verify the validity of entries and entrants (including your identity, age and location); and
- disqualify any entrant whose entry is not in accordance with these Terms or who otherwise tampers or interferes with the entry process.
- If there is a dispute as to your identity or details, we reserve the right to determine your identity or details and our determination is final.
4. Draw
- There will be 3 winners.
- We will randomly draw the winners:
- at 11:00am AEST on 1 September 2023; and
- at our office at Level 30, 580 George Street, Sydney, New South Wales, 2000.
- We may draw reserve entries in the event a winner is disqualified in accordance with these Terms.
- Our draw is final.
- The winners will be notified by email by 5:30pm on 5 September 2023.
- It is your responsibility to ensure the email address associated with your store’s account on Uber Eats is accurate and up to date.
- We will publish the winners at 5:00pm AEST on 13 September 2023 on the Uber Blog.
- We may also publish the winners on our social media pages or other promotional material. By entering the Competition, you consent to us publishing your details.
5. Prizes
- The total prize pool for the Competition is AUD$2,504.04 and comprises:
- 1st Prize: a promotional code that you can use to purchase 12 months’ worth of Uber Eats Green Bags (being 24 cartons, valued at $1,430.88), which will be awarded to the first entrant drawn as a winner;
- 2nd Prize: a promotional code that you can use to purchase 6 months’ worth of Uber Eats Green Bags (being 12 cartons, valued at $715.44), which will be awarded to the second entrant drawn as a winner; and
- 3rd Prize: a promotional code that you can use to purchase 3 months’ worth of Uber Eats Green Bags (being 6 cartons, valued at $357.72), which will be awarded to the third entrant drawn as a winner,
(each a Prize).
- The prizes were valued based on the regular retail price in Australia as at the commencement of the Promotion Period. We accept no liability for any change to the regular retail price on the date the Prizes are provided or redeemed.
6. Redemption of Prizes
- Each winner will be provided with the Prize, which may be redeemed via the Detpak Uber Eats portal.
- Prize winners must do the following to redeem their Prize:
- Login to ubereats.detpak.com using your Detpak account email and password;
- Add the green Uber Eats paper bags to your cart; and
- Apply the promotional code at checkout to redeem your carton(s).
7. Prize conditions
- Use of the Prizes is subject to any terms and conditions provided by us and any terms that apply to the use of the Detpak Uber Eats portal.
- Each Prize will expire on the earlier of:
- the date that the maximum number of cartons available for that Prize is exhausted; and
- in the case of the:
- 1st Prize: 12 months after the Prize is provided;
- 2nd Prize: 6 months after the Prize is provided; and
- 3rd Prize: 3 months after the Prize is provided.
- You will forfeit any portion of the Prize that is unused as at the date of expiry set out in clause 7(b).
- We are not liable for any additional, incidental, or related costs in connection with winning the Competition or the Prizes offered.
- Without limiting clause 7(d), delivery fees apply to orders placed via the Detpak Uber Eats portal and you are responsible for those costs.
- You should seek independent advice, including financial advice, as implications (such as tax) may arise as a result of winning the Prize.
- Prizes are not transferable, saleable or redeemable as cash, credit or equivalent.
8. Entries
- We are not liable in any way for your entry, to the fullest extent permitted by law.
- You warrant and agree that:
- you will not submit any entry that is unlawful or fraudulent, or that we could reasonably consider to be:
- harmful or disparaging of us, our Related Bodies Corporate and any of their product, services, officers, employees or contractors; or
- in breach of any intellectual property rights, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication;
- you will obtain prior written consent from any person who has jointly created, or has rights in, your entry, to these Terms; and
- you will comply with all applicable laws and regulations, including those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
- you will not submit any entry that is unlawful or fraudulent, or that we could reasonably consider to be:
9. Personal information
- Entries may be entered into a database.
- By entering the Competition, you consent to us:
- collecting and using your Personal Information for matters related to this Competition;
- disclosing your Personal Information to any service providers who are assisting us with conducting the Competition;
- publishing or disclosing your Personal Information as required by relevant laws or specified in these Terms; and
- for the purposes of conducting the Competition, communicating with you and contacting you if you win a Prize.
- You can contact us if you wish to access, or request a correction to, your Personal Information.
- You warrant that if your entry contains Personal Information of another individual, you have notified them of the matters in this clause and obtained their consent.
- We may disclose your Personal Information to our Related Companies for the purposes described above.
- If you do not consent to the collection, use and disclosure of your Personal Information for the purposes described above, you must enter the Competition.

10. Liability
- Nothing in these Terms excludes, restricts or modifies any rights or remedies under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified.
- Subject to clause 10(a) and to the fullest extent permitted by law, we and our Related Bodies Corporate (and each of their officers, directors, employees, contractors and agents):
- are not responsible for any error, omission, interruption, delay in operation or transmission, communications line failure or any other event beyond our control. In these circumstances, if we elect to cancel or postpone the Competition, we do so without liability and may reschedule it on the same terms;
- make no express or implied warranties, representations or guarantees, in fact or in law, regarding the Competition or the merchantability, quality or fitness for purpose of any part of the prizes; and
- exclude all liability (including for negligence) for any personal injury or loss or damage (including for loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Competition, including where arising out of:
- any technical difficulties or equipment malfunction (whether or not under our control);
- any theft, unauthorised access or third party interference;
- any entry or prize claim that fails to be transmitted or is cancelled, delayed, deleted, interrupted or late (whether or not after our receipt or otherwise);
- any variation in prize value or specification;
- any tax liability or similar charge incurred by a winner; or
- use of a prize by a winner.
- We are not responsible for any problem or technical malfunction of any telephone network or lines, computer systems, servers, providers or equipment, software, traffic congestion on the internet or any website, or any combination of those, including any injury or damage to entrants or any other person’s computer related to or resulting from participating in the Competition.
- You are solely responsible for any costs associated with entering the Competition, noting these costs may depend on the internet service provider you use.
- Without limiting any other terms, you indemnify us and our Related Bodies Corporate (and their officers, directors, employees, contractors and agents) from and against your breach of these Terms.
11. Disruption to Competition
- If, for any reason, the Competition is affected or interfered with in any way or is not capable of being conducted as planned due to a Force Majeure Event, including where such circumstance corrupts or affects the administration, security, fairness or integrity or proper conduct of the Competition, we may, to the fullest extent permitted by law:
- disqualify any entrant who tampers or interferes with the entry process; or
- subject to required regulatory approval, cancel, terminate, modify, reschedule or suspend the Competition, as appropriate.
- Any entrant found to be tampering or interfering with the entry process will have all entries invalidated and any claim to a prize will be invalidated. We will determine whether a breach has occurred at our discretion and may request any documentation.
12. General
- Any failure to enforce our rights does not constitute a waiver of those rights.
- To the extent permitted by law, the Competition may be withdrawn or cancelled at any time at our discretion.
- Any part of these Terms that is illegal, void or unenforceable may be severed, and the remainder will continue in force.
- At all relevant times, you must comply with the terms of use that are applicable to your Uber Eats merchant account and Instagram accounts.
- Unless otherwise stated, the plural includes the singular (and vice-versa).
- The Competition and any issues relating to the construction, validity, interpretation and enforceability of these Terms will be governed by the laws of New South Wales, Australia.
- The promoter of the Competition is Uber Australia Pty Ltd (ABN 49 160 299 865) of 580 George Street, Sydney, New South Wales, 3000.

13. Definition
- Force Majeure Event means an event or circumstance beyond our reasonable control, including natural disaster, acts of war, riots, vandalism, failure or shortage of power supplies or other essential utility, pandemic, epidemic, quarantine or other widespread or serious threat to human health (including an outbreak or recurrence), strike, a change in applicable law or platform rules, government imposed shutdown or closure, infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures, down time or issues.
- Immediate Families means any of the following (whether natural, step or adopted): spouse, ex-spouse, de-facto spouse, child, parent, grandparent, uncle, aunt, niece, nephew or sibling.
- Personal Information has the meaning in the Privacy Act 1988 (Cth).
- Related Bodies Corporate has the meaning in the Corporations Act 2001 (Cth).
