Terms & Conditions

1. Overview

(a) The Uber x Qantas Frequent Flyer competition (Competition) is promoted by Uber Australia Pty Ltd (ABN 49 160 299 865) (we, us or our)
(b) By entering the Competition, all entrants (you or your) agree to be bound by these terms and conditions (Terms) and our Privacy Notice. Any breach of these Terms may result in disqualification from the Competition.
(c) To the extent of any inconsistency between these Terms and any other reference to the Competition, these Terms prevail.
(d) The Competition:
(i) begins at 12:01am AEST on 11 April 2024; and
(ii) ends at 11:59pm AEST on 30 April 2024,
(Promotion Period).

2. Eligibility

(a) This Competition is open to Australian residents aged 18 years or over. 
(b) Employees and contractors (and their Immediate Families) of Uber Australia Pty Ltd and Qantas Airways Limited, our Related Bodies Corporate and the agencies associated with this Competition are ineligible to participate in this Competition.

3. How to enter

(a) The Competition is a game of chance.
(b) To enter the Competition, you must have linked your Uber and Qantas Frequent Flyer accounts before the end of the Promotion Period. You will be automatically entered into the Competition if you linked your accounts before the Promotion Period began. You will receive an entry into each draw from the date the accounts are linked or the first day of the Promotion Period (whichever is later), until the end of the Promotion Period.
(c) You will receive an additional entry into a draw for each Uber ride to or from an Eligible Airport outlined below during the Promotion Period. You must ensure your Uber and Qantas Frequent Flyer accounts are linked in the Uber app, Qantas app or via the Qantas Frequent Flyer website on or before the day you complete the Uber ride in order to receive the additional entry. Your additional entry will go into the draw for the day you completed the Uber ride.

(d) You can have multiple entries into the Competition but can only win once.
(e) We will not accept entries outside the Promotion Period.
(f) The time of each entry will be the time and date of completion of the Uber ride displayed to us on the Uber app.
(g) We may, at any time:
(i) verify the validity of entries and entrants (including your identity, age and location); and
(ii) disqualify any entrant whose entry is not in accordance with these Terms or who otherwise tampers or interferes with the entry process.
(h) If there is a dispute as to your identity or details, we reserve the right to determine your identity or details and our determination is final.

4. Draws and winners

(a) There will be a random draw for the entries received on each day of the Promotion Period (total 20 draws) and 1 winner per draw (total 20 winners).
(b) The draws will be conducted once per week during the Promotion Period as follows:

(c) Draws will be conducted at TPAL at Level 2, 11 York Street, Sydney, New South Wales, 2000.
(d) We will draw additional valid entries and record them in case an invalid entry, previous winner, or ineligible entrant is drawn.
(e) Our draws are final and no correspondence will be entered into
(f) We will notify each winner by email to the email address on your Uber account within 48 hours of the draw. Winners will not need to do anything to claim the Prize.
(g)The name of the winners will be published on p.uber.com/qantascompetition. We may also publish their names on our websites and social media pages, and in any other promotional material that we consider relevant. By entering the Competition, you consent to us publishing your details.
(h) If a Prize cannot be loaded into a winner’s Qantas Frequent Flyer account in accordance with 5.(a), that winner forfeits the Prize.

5. Prize
(a) Each winner will receive 1 million Qantas Points to their Qantas Frequent Flyer account (notional value of AUD$58,878.30) (Prize) within 21 days of the end of the Promotion Period.
(b) The total Prize pool for the Competition is 20 million Qantas Points (notional value of total Prize is approximately AUD$1,177,566)
(c) The notional value is based on a sample of the Qantas Frequent Flyer Rewards that could be obtained by redeeming through the Qantas Frequent Flyer program (as fully defined in the terms and conditions of the program available at qantas.com/terms). For example, 41,900 Qantas Points could be redeemed for a Flex one way Economy Classic Flight Reward from Sydney to Los Angeles plus AU$217 in applicable taxes, fees and carrier charges, accurate as at 16 February 2024. The dollar fare for an equivalent commercial flight totals AU$2,684 including taxes, fees and carrier charges.
(d) The estimate of the maximum notional value of each prize is provided for information purposes only. The maximum notional value of each prize will vary depending on whether and how it is redeemed by a winner through the Qantas Frequent Flyer program. The Promoter accepts no responsibility for any variation in the maximum notional value of each prize.
(e) Each Prize is awarded and must be redeemed, in accordance with and subject to the Terms and Conditions of the Qantas Frequent Flyer program (Qantas.com/terms), the Qantas Store Terms of Use (Qantas.com/store), voucher terms and conditions (including expiry rules) if relevant, and any other terms and conditions disclosed at the time of redemption.
(f) The redemption of each Prize is subject to the availability of rewards that may be obtained through the Qantas Frequent Flyer program.
(g) Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services.  A prize cannot be transferred to any other person, unless agreed to by the Promoter.  It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.
(h) If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
(i) We are not liable for any additional, incidental, or related costs in connection with winning the Competition or using the Prize. 
(j) You should seek independent advice, including financial advice, as implications (such as tax) may arise as a result of winning the prizes.
(k) Use of the Prize is subject to the Qantas Frequent Flyer Terms and Conditions. Prizes are not transferable, saleable or redeemable as cash, credit or equivalent. 

6. Personal information

(a) By entering the Competition, you consent to us:
(i) publishing your Personal Information, or disclosing your Personal Information as required by relevant laws;
(ii) using your name and photograph for promotional purposes, unless you otherwise notify us at the time of receiving the prize; and
(iii) using your Personal Information to communicate with you about the Competition, including contacting you about the outcome of the draw and providing the Prize if you are a winner.
(b) If you wish to access, or for us to correct, your Personal Information, contact us here.
(c) We may disclose your Personal Information to our Related Companies for the purposes described above.
(d) If you do not consent to the collection, use and disclosure of your Personal Information for the purposes described above, you must not enter the Competition and must notify us that you would not like to participate in the Competition.
(e) Please see our Privacy Notice for more information about our privacy practices, including:
(i) how you may access, correct or delete your Personal Information; and
(ii) how you may make, and how we will handle, a privacy complaint.

7. Liability

(a) Nothing in these Terms excludes, restricts or modifies any rights or remedies under the Australian Consumer Law that cannot be excluded, restricted or modified.
(b) Subject to clause 8(a) and to the fullest extent permitted by law, we and our Related Companies (and each of their officers, directors, employees, contractors and agents):
(i) are not responsible for any error, omission, interruption, delay in operation or transmission, communications line failure or any other event beyond our control. In these circumstances, if we elect to cancel or postpone the Competition, we do so without liability and may reschedule it on the same terms;
(ii) make no express or implied warranties, representations or guarantees, in fact or in law, regarding the Competition or the merchantability, quality or fitness for purpose of any part of the Prize; and
(iii) exclude all liability (including for negligence) for any personal injury or loss or damage (including for loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Competition, including where arising out of:
(A) any technical difficulties or equipment malfunction (whether or not under our control);
(B) any theft, unauthorised access or third party interference;
(C) any entry or prize claim that fails to be transmitted or is cancelled, delayed, deleted, interrupted or late (whether or not after our receipt or otherwise);
(D) any variation in Prize value;
(E) any tax liability or similar charge incurred by the winner; or
(F) use of a Prize by a winner.
(c) We are not responsible for any problem or technical malfunction of any telephone network or lines, computer systems, servers, providers or equipment, software, traffic congestion on the internet or any website, or any combination of those, including any injury or damage to entrants or any other person’s computer related to or resulting from participating in the Competition.
(d) You are solely responsible for any costs associated with entering the Competition, noting these costs may depend on the internet service provider you use.
(e) Without limiting any other terms, you indemnify us and our Related Bodies Corporate (and their officers, directors, employees, contractors and agents) from and against your breach of these Terms.

8. Disruption to Competition

(a) If, for any reason, the Competition is affected or interfered with in any way or is not capable of being conducted as planned due to a Force Majeure Event, including where such circumstance corrupts or affects the administration, security, fairness or integrity or proper conduct of the Competition, we may, to the fullest extent permitted by law: 
(i) disqualify any entrant who tampers or interferes with the entry process; or
(ii) subject to required regulatory approval, cancel, terminate, modify, reschedule or suspend the Competition, as appropriate.
(b) Any entrant found to be tampering or interfering with the entry process will have all entries invalidated and any claim to a prize will be invalidated. We will determine whether a breach has occurred at our discretion and may request any documentation. 

9. General

(a) Any failure to enforce our rights does not constitute a waiver of those rights.
(b) To the extent permitted by law, the Competition may be withdrawn or cancelled at any time at our discretion.
(c) Any part of these Terms that is illegal, void or unenforceable may be severed, and the remainder will continue in force.
(d) Unless otherwise stated, the plural includes the singular and vice-versa.
(e) The Competition and any issues relating to the construction, validity, interpretation and enforceability of these Terms will be governed by the laws of New South Wales, Australia.

10. Definitions

(a) Force Majeure Event means an event or circumstance beyond our reasonable control, including natural disaster, acts of war, riots, vandalism, failure or shortage of power supplies or other essential utility, pandemic, epidemic, quarantine or other widespread or serious threat to human health (including an outbreak or recurrence), strike, a change in applicable law or platform rules, government imposed shutdown or closure, infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures, down time or issues.
(b) Immediate Families means any of the following (whether natural, step or adopted): spouse, ex-spouse, de-facto spouse, child, parent, grandparent, uncle, aunt, niece, nephew or sibling.
(c) Personal Information has the meaning in the Privacy Act 1988 (Cth).
(d) Related Bodies Corporate has the meaning in the Corporations Act 2001 (Cth).
