Uber- the official rideshare partner of the Formula 1® Rolex Australian Grand Prix 2019

3. Entry is only open to individuals aged 18 years or over who who the Uber app as either riders and/or driver-partners. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion 1 commences from Thursday 7/3/19 and ends at 9am on Tuesday 12/3/19. Promotion 2 commences Wednesday 13/3/19 7.30pm and ends 9pm.(each a “Promotional Period”, as applicable). All times indicated are in AEDT Melbourne time.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

9. The judging of Promotion 1 will take place at 9am AEDT on Tuesday 12/03/2019 at 580 George Street, Sydney. The Promoter may judge additional reserve entries and record them in order in case an invalid entry or ineligible entrant is determined as a winner. The judging of Promotion 2 will take place at 9pm AEDT on Wed 13/03/2019 at Albert Park, Melbourne. 10. The winners from Promotion 1 will be contacted by direct message on Facebook/ Instagram within 24 hours of the winner being chosen and will be sent more information via email. The winners from Promotion 2 will be announced on the same night at the Glamour on The Grid Event at 9pm and will be sent more information via email.

11. The Promoter’s decision is final and no correspondence will be entered into.

13. Prizes are not exchangeable or transferable and cannot be taken as cash unless specified otherwise.

14. A judging for any of the prizes, if unclaimed, may take place at the same time and place as the original judging 30 days from the date of the initial judging, subject to any directions from a regulatory authority.

15. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions of any regulatory authority.

16. Entrants consent to the Promoter and its affiliates using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, or conduct of third parties involved in the delivery of any part of the prize, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the state the judging is conducted (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking/use of a prize.

20. This contest is not sponsored, endorsed or administered by Facebook or Instagram. By submitting an entry, you agree to release Instagram from all liability in relation to the contest.

21. The ride in the Formula 1 Australian Grand Prix 2-Seater car is a significant stress, particularly on the neck and the heart. This car accelerates from 0-250 km/hr in about 10 seconds and corners at very high speed. Given the significant speed and forces involved, it is possible, although very unlikely, that an injury could be sustained or a heart complication could occur. In order to participate in the activity, the winner/participant must be within the following age, height, weight and body dimension restrictions:
(a) Minimum age: 18 years
(b) Maximum height: 1.83 m (6 ft)
(c) Minimum height: 1.58 m (5 ft 2 in)
(d) Maximum weight: 88 kg
(e) **Maximum girth is at the chest and includes the upper arms: 139.7cm (55 in).

22. If any of the winners from Promotion 1 do not meet the restrictions, they are able to nominate a family/friend to claim the prize instead. This nominated person needs to qualify for the bodily dimensions above and must be confirmed by Monday 11/3/19 at 5pm AEST. If any of the winners from Promotion 2 do not meet the restrictions, they are able to nominate a family/friend to claim the prize instead. This nominated person needs to qualify for the bodily dimensions above and must be confirmed by Wed 13th March 2019 at 10pm AEDT.

23. Each winner will need to complete and sign the medical evaluation form, and the waiver & indemnity form provided by AGPC.

24. Winners who live interstate will be provided accommodation for one night at Art Series – The Olsen South Yarra in the Deluxe Studio Suite with Bed & Breakfast Included from Wednesday 13/3/19 – Thursday 14/3/19. Flights will not be covered.
