TERMS & CONDITIONS of Uber Instagram Picture Contest

Please read these Terms and Conditions (“Contest Terms”) carefully prior to participating in Uber Instagram Picture Contest (the “Contest”). By participating in the Contest each participant fully and unconditionally agrees to and accepts these Terms and Conditions. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Contest Terms unless you agree to these Contest Terms.

Contest Timeline: The Contest begins on 28th of October 2016 2pm Central European Time Zone and ends on 1st of November 2016 11:59 pm Central European Time Zone.

The winner will be selected by Uber between the 2nd of November and the 3rd of November 2016. The winner will be contacted and provided with all information about how to redeem the prize through his/her personal email not later than the 4th of November 2016. The prize should be redeemed by the winner before the 6th of November 2016.

Contest Area: Belgium.

The Contest is organised and sponsored by Uber B.V., a private limited liability company incorporated under the laws of the Netherlands (registration number 56317441), whose registered address is Vijzelstraat 68, 1017 HL Amsterdam, the Netherlands (“Uber” or “Sponsor”).

Eligibility: To be eligible to enter the Contest, a Participant must: (a) be a citizen of Belgium or a legal Belgian resident; and (b) be at least eighteen (18) years old (the age of majority in Belgium); (c) have an Uber account, i.e. must have downloaded the Uber mobile app, installed it into the smartphone and accepted the terms of use. By entering the Contest, you warrant that you satisfy these eligibility requirements.

Uber reserves the right to disqualify any participant from the Contest if, in Uber’s sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants or Uber.

How to enter

In order to enter the Contest all the actions described below must be performed within the Contest Timeline.

The Participants enter the Contest by uploading original photographs through the free Instagram app for iPhone, iPod touch and iPad. A purchase or transaction is not required to participate or win.
The Participants enter the Contest by following the @uber_bxl Instagram handle and providing photographs through the Instagram app, mentioning the @uber_bxl handle and marking each photo with the hashtag #UBERSCARY. To be judged as part of the Contest, the entries must follow the @uber_bxl Instagram handle and include the mentioned hashtag.

Number of entry into the Contest is limited to one per Uber user.

Those who performed all the actions described above and comply with eligibility requirements are considered to have submitted an entry to the Contest and become Participants of the Contest.

Uber is entitled to suspend an entry into the Contest for any person which does not comply with the eligibility requirements specified above in the present Contest Terms.

How the winner is selected

The winner will be selected on the basis of skill. The jury consisting of 3 Uber employees will choose the best pictures by voting. The jury judges every contribution (with the correct hashtag) and gives out points to their favorite entries.
The owner of the picture with the highest number of votes by the end of the Contest wins the contest.
Please note, all Participants are subject to a final screening process by Uber once the Contest has closed. The winner will be contacted and provided with all information about how to redeem prize through personal emails not later than the 4th of November 2016.

Prize

The Prize will be assigned by Uber to the winner.

The Prize is a month of free Uber rides subject to the following limitations: (i) maximum number of rides – 40 (forty), and (ii) maximum value of each ride – €20. In order to redeem the Prize winner shall enter the promocode that will be provided to the winner via personal email. Winner will be liable for the excess amount of any rides that exceeds the value of the Prize. The promocode is valid in Belgium only, expires 30 days after the winner enters the promocode.

EACH PRIZE IS NON-TRANSFERABLE AND CANNOT BE EXCHANGED FOR CASH.

Uber is fully entitled to refuse to give out a prize in case it reveals violation or non-compliance with the present Contest Terms. Uber is entitled to decide what to do with unredeemed prizes at its own discretion.

Taxes

The winner must fully understand that if s/he redeems and receives a prize, s/he is obliged to comply with tax legislation of Belgium and pay the income tax. Uber has no obligations to safeguard that the winners of the Contest adhere to their obligation to pay any taxes.

Privacy

Participants agree and acknowledge that personal data submitted with an entry, including name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by Uber and its affiliates and transferred to partners of Uber which provide prizes for the Contest for the purposes of conducting and administering the Contest, which could include a transfer to a country with less strict data protection laws than the one you reside in, depending on the prize. Individuals submitting personal information in connection with the Contest have the right to request access, review, rectification or deletion of any personal data held by Uber in connection with the Contest by writing to Uber at the following address: Vijzelstraat 68, 1017 HL, Amsterdam, The Netherlands, attn: Privacy.

Media Release

By entering the Contest, you confirm that you irrevocably consent to the use of your name, statements, quotes, stories, image/photograph, appearance, likeness and/or other information, including any audio-visual recordings of you, for all advertising, promotional or other commercial or non-commercial purposes of Uber, its affiliates and/or related third parties in all media now or hereafter known, worldwide and in perpetuity without additional compensation.

Warranties and Indemnities

To the maximum extent permitted by law, Participant indemnifies and agrees to keep indemnified Uber at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, Participant agrees to defend, indemnify and hold harmless Uber from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from: (i) any misrepresentation made by Entrant in connection with the Contest; (ii) any non-compliance or improper understanding by Participant of these Contest Terms; (iii) acceptance, possession, misuse or use of any prize.

Governing law: These Contest Terms shall be governed by and construed in accordance with the laws of the Netherlands and the District Court of Amsterdam shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Contest.
