These terms and conditions apply to your use of discounted trips in Estonia.
READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS PROMOTION. AMONG OTHER THINGS, THESE TERMS AND CONDITIONS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.

1. Definitions
1.1 The following words and phrases have the meanings shown next to them:
1.1.1 “Uber” means Uber B.V. of Mr. Treublaan 7, 1097 DP Amsterdam, the Netherlands and/or the Uber applications, websites, content, products, and services enabling access to request transportation and/or logistics services with independent third party providers of such services. Uber is the Promoter of this promotion.

1.1.2 “You” means the holder of an eligible Uber account registered in Estonia. Please refer to the offer terms set out below for the eligibility requirements applicable to the offer.
1.1.3 “Rides” mean journeys booked using the Uber app in cities where Uber is present: Tallinn (excluding journeys that are booked using a Family or a Business profile).
2. Eligibility Criteria
2.1 Please refer to the offer terms set out below for the eligibility requirements applicable to the offer.
2.2 Only users who have received communication featuring discounted trips in Estonia are eligible for the promotion.
2.3 The promotion is open to individuals aged 18 years (or the equivalent age of majority in their country of citizenship/residence) or over who have an Uber account and are compliant with the Uber User Terms applicable in the country of the promotion marketing (as found here: https://www.uber.com/legal/terms), except employees of the Promoter, their families, agents or any third party directly associated with administration of the Promotion. Proof of age and/or identity and/or residency may be required.

3. General terms
3.1. The offers apply to the use of the Uber app to book transport. They don’t apply to any other Uber product, and can’t be used in conjunction with any other Uber offer or promotion.
3.2 Offer gives you a discount on rides in Tallinn. The amount of the discount is communicated individually via email send out. Discounted rides must be within administrative borders of Tallinn and are subject to the availability of Uber driver-partners.
3.3 The maximum value of the discount is communicated individually via email. The discount will apply automatically. You won’t have to do anything more to claim your discounted ride – the discount will apply automatically.
3.4 Discounted rides are subject to the maximum value set out in the relevant offer terms. If you qualify for a discounted ride but your ride exceeds the maximum value, the excess will be charged to your eligible payment method. If your ride is less than the maximum value, you won’t be able to carry over any unused value towards your next ride.
3.5 Discount will apply only to the number of trips communicated individually via email. The next rides will be charged to your eligible payment method according to the trip cost.
3.6 Discounted rides can’t be sold or transferred, or otherwise redeemed for cash.
3.7 The offer is valid until 16.03.2020.

4. Getting in touch:
4.1 If you have questions relating to the promo code use, Uber, or your use of the Uber service or app, please contact Uber’s customer services via in-app support in the Uber app or at https:/help.uber.com/.
4.2 If you think you’ve been charged incorrectly when you were eligible for a discounted ride, please get in touch with Uber. Uber’s own terms apply to your use of the Uber app.
4.3 This promotion will be available for the period of time specified in the relevant offer terms. If no period of time is specified therein, the promotion will be available for a limited time only at Uber’s sole discretion. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion or where it becomes necessary to do so.
4.4 Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon participation in the promotion. The Promoters reserve the right to refuse participator in the promotion to anyone in breach of these Terms and Conditions.
4.5 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate a participator, accept any liability (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for any loss, damage, personal injury or death arising out of or in connection with any participant’s participation in this promotion whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not the Promoter or its affiliates have been advised of the possibility of such loss, damage, personal injury or death. Your statutory rights are not affected. Any liability of the Promoter arising in connection with this promotion shall be several and the Promoter accepts no joint and several liability in connection with this promotion.
4.6 The Promoter reserves the right to modify and amend these Terms and Conditions from time to time during this promotion period.
4.7 The invalidity or unenforceability of any provision, or part thereof, of these Terms and Conditions, will not affect the validity or enforceability of any other provision or part thereof. In the event that any provision, or part thereof, of these Terms and Conditions, is determined to be invalid or otherwise unenforceable or illegal, the other provisions, or parts thereof, will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Promoter’s failure to enforce any term of these Terms and Conditions will not constitute a waiver of that term or any other provision of these Terms and Conditions.
4.8 In the event there is a discrepancy or inconsistency between disclosures or other statements contained in this promotion-related materials and these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Promoter’s sole and absolute discretion.
4.9 All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms and conditions, or the rights and obligations of the participants and the Promoter or its affiliates in connection with this promotion (whether contractual or non-contractual), shall be governed by, and construed in accordance with the laws of the Netherlands.
