Uber – Driver Go Pass Terms and Conditions (Helsinki)

KEY PRINCIPLES

PARTIES 

These Driver Go Pass Terms as defined herein are entered into between you and Uber B.V.  a private limited liability company established in the Netherlands, having its offices at Mr. Treublaan 7, 1097 DP, Amsterdam, The Netherlands, registered at the Amsterdam Chamber of Commerce under number 56317441 (“Uber”). 

You are an independent in the business of providing transportation services (“You”, “Your”, “Driver”, “Partner”).

Go Pass is a service provided by Uber that entitles you to access the Uber Driver App and locate and accept unlimited trips, subject to any restrictions on duration which you may operate on the Uber Platform. 

Go Pass is post paid, meaning you will need to ensure that you have settled any amounts due to Uber for the Go Pass upon expiry of your Go Pass before you can purchase a new Go Pass. See further under Section 5. Uber does not impose any other fees in exchange for the services provided to you. 

Subject to Section 4 below, except where required by law, Go Passes are non-refundable.

Uber offers Go Passes of varying Validity (eg 1 day, 7 days, 14 days). The cost of a Go Pass (the “Rate”) will depend on the Validity and will be presented to you in the Uber Driver App at the time of selection.  YOUR GO PASS DOES NOT AUTOMATICALLY RENEW. 

4.  Selection and Activation.

The Go Pass will activate immediately upon selection and you will see a negative balance in your Uber Driver App reflecting the value of your selected Pass (‘Negative Balance’). YOU MUST FULLY SETTLE YOUR NEGATIVE BALANCE BEFORE YOU CAN SELECT A NEW GO PASS AND ACCESS THE UBER DRIVER APP.  

5. Payment.

Payment is due to be paid by you in full upon expiration of your then current Go Pass and the amount due to be paid by you will be reflected in your Driver App as ‘Negative Balance’. 

You agree that Uber and/or its Affiliates will deduct from any Trip Payment (where ‘Trip Payment’ refers to the fare you are entitled to receive from digital payments collected by Uber for each Ride you complete (after deducting any agreed amounts)) or other monies payable to you at any time in accordance with the Uber Terms, any Negative Balance which you owe to Uber.

Subject to applicable law, Uber reserves the right to modify or stop offering Go Pass, or to change Pass Benefits or Rates, at any time in its sole discretion. If your Rate increases, or your Pass Benefits materially change, we will honour your existing Go Pass until its Validity runs out.

We may terminate your Go Pass at our discretion without notice.  Where you are entitled to a refund in accordance with applicable law, please contact customer service by way of the Uber Driver App. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these Driver Go Pass Terms, the Uber Terms, any applicable law, or involves fraud or misuse of the Go Pass. Uber, at its discretion, may terminate your Go Pass effective at the end of the Validity of the Go Pass by providing you notice of such termination. If that happens, you will have access to your Pass Benefits (if any) until the end of their Validity.

Notwithstanding the terms and conditions of other promotions offered through Go Pass, Uber in its sole discretion may permit or offer pass benefits, which it may also allow to be combined with other promotions, subject to applicable law (the “Pass Benefits”).

Uber and/or third parties on behalf of Uber may offer some users a free trial or other promotional entitlement to Go Pass. Such trial or promotional entitlement is subject to these Driver Go Pass Terms except as otherwise stated in the offer. Only one trial or promotional entitlement is available per user. Free trial eligibility is determined by Uber at its sole discretion and Uber may limit such eligibility or duration to prevent free trial abuse. Certain limitations may exist with respect to combining a free trial with any other offers.

Uber reserves the right to modify these Driver Go Pass Terms. If we make material changes while you have an active Go Pass, we will notify you either in the Uber Driver App and/or via email. Revised Driver Go Pass Terms become effective upon notification to you and each selection and use of a Go Pass constitutes your acceptance of the revised terms.

Uber’s rights and obligations under the Driver Go Pass Terms may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.

All interpretations of these Driver Go Pass Terms will be at Uber’s sole discretion and Uber’s decisions will be final.

Go Pass and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Go Pass program or its features that are outside of Uber’s reasonable control. Uber may from time to time request information from you to confirm your identity. Uber may delay your access to Go Pass until you comply with this information request. Go Pass and all the information accessible through it are provided for information purposes only on an “as is” and “as available” basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of Go Pass, the information, materials, content, availability, and products. Go Pass and these Driver Go Pass Terms are provided by Uber and do not modify the contractual relationships among or between the individuals and entities that could be used to offer our services, and Uber, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, as well as liability for delays, lost profit, or property damage.
