Terms and Conditions
This Uber Gift Card Agreement (“Agreement”) is between the purchaser and/or redeemer (“you”) of a Uber Gift Card (“Gift Card”), and Uber B.V. (“Uber”). This Gift Card is issued by Uber. Uber may engage third parties in connection with the sale and distribution of Gift Cards. Uber is not responsible for Gift Cards sold or distributed by a third party not approved by Uber. By purchasing and/or redeeming the Gift Card, you accept the following terms and conditions:
You must have an active and valid Uber account to redeem the Gift Card. The Gift Card is redeemable with Uber B.V. in exchange for Uber Money via the Uber®️ or Uber Eats app (“Uber app”) in areas in the European Economic Area where Uber Money and Uber or Uber Eats are available.
Uber Money is a regulated e-money product in the EEA, issued by Uber Payments B.V. Uber Money can be used as a method of payment on the Uber apps. Your use of Uber Money is subject to the Uber Money Terms and may be restricted in accordance with EEA legislation, as specified in the Uber Money Terms. Please follow these steps to redeem the Gift Card in the Uber app:
1) Go to the profile icon in the Uber app 2) Tap “wallet”; 3) Tap “Add Funds (Uber Money)” 4) Tap “Add Gift Code” 5) Enter the card’s Gift Code 6) Add in KYC info (will depend on amount of topup)
You may be required to add a secondary payment method to use the Gift Card with the Uber app. To prevent fraud and to comply with EEA legislation, including regarding anti-money laundering, counter terrorism financing and sanctions, you will be required to provide certain information when redeeming your Gift Card for Uber Money. Limits may apply to your redemption of the Gift Card. No fees apply to the Gift Card. This Gift Card expires 1 year after the date of purchase, except where applicable law provides otherwise, in which case the minimum expiration term will apply.
The Gift Card is non-reloadable, which means it cannot be reloaded with additional funds after purchase. The Gift Card is not redeemable for cash or other funds except where required by law and may not be used to make a payment on a credit account. This gift card cannot be refunded or returned, except where required by law, in which case the Gift Card can only be refunded or returned within 14 days from the date of receipt, except if you have already fully or partially redeemed your gift card, after which it is non-refundable and non-returnable. Refunded or returned Gift Cards will be canceled and can no longer be redeemed. You may not purchase other Gift Cards with the Gift Card. The Gift Card is a payment instrument and cannot be treated as a voucher as defined in Article 30a of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax.
Uber reserves the right to sell, transfer or assign the issuance of the Gift Card and/or funds underlying the Gift Card to another issuer, without notice to you. The risk of loss of the Gift Card passes to the Gift Card purchaser at the time of purchase. Uber shall not be responsible for lost, stolen or destroyed Gift Cards, and is not responsible for unauthorised use of the Gift Card. IN THE EVENT THAT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY (AND UBER’S SOLE POTENTIAL LIABILITY) SHALL BE THE REPLACEMENT OF SUCH GIFT CARD.
Uber reserves the right to void the Gift Card if the issuer suspects that the Gift Card was obtained or used fraudulently, unlawfully or otherwise in violation of this Agreement.
Uber may modify any of this Agreement’s terms and conditions at any time, upon 2 months’ written notice to you, which notice shall set out the existing provisions and amended provisions, the date of the coming into force of the modification and, if applicable, your right to refuse the modification as described in the next sentence. You may refuse a modification which involves an increase of your obligations or a reduction in Uber’s obligations by sending Uber a notice to that effect prior to the end of the 2 months notice period referred to above. If you do not send such an objection, you will be considered to have accepted the modification and the modification will come into force. The most current Agreement shall be available at uber.com/legal/gift, and will supersede all previous versions of the Agreement. The most current Agreement shall be effective upon the issuer’s posting of such modified Agreement. Your use of the Gift Card after such posting constitutes your acceptance of the modified Agreement. Redemption of the Gift Card is also subject to the terms of use governing your Uber account and your Uber Money account.
If any term of this Agreement is deemed to be invalid, void or for any reason unenforceable, such term shall be deemed severable and will not affect the validity and enforceability of any remaining terms of this Agreement. For customer service, please visit uber.com/legal/gift.
GOVERNING LAW AND JURISDICTION
These Gift Card terms are exclusively governed by Dutch law, excluding its rules on conflicts of laws. However, if you reside in the EU, statutory consumer protection regulations in your country of residence that are more beneficial for you may apply. The Vienna Convention on the International Sale of Goods of 1980 (CISG) shall not apply. Any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the Uber Money Terms, including those relating to its validity, its construction or its enforceability, shall be settled as follows. If you are a consumer and reside in the EU, you may bring judicial proceedings relating to these terms before the competent court of your country of residence. We may only bring judicial proceedings against you in your country of residence in the EU.
