Uber Pro Terms and Conditions
Uber Pro (the “Program”) is brought to you by Uber Rasier Canada Inc. or its respective subsidiaries, licensees and affiliated companies (collectively “Uber” or “we”). These Program Terms (defined below) constitute a legal agreement between you and Uber.
Participation in the Program is also subject to the Terms and Conditions, the general Privacy Policy, and your Uber Platform Access Agreement, which are incorporated herein (collectively, the “Program Terms”). By participating in this Program you are agreeing to these Program Terms.
Uber is a technology company, not a provider of transportation services; as such, all rewards offered under the Program are offered on an “as available” basis, contingent upon requests from riders for the transportation services and other contingencies which may impact availability of some rewards at certain times and places.
YOU UNDERSTAND THAT UBER MAY TERMINATE OR MODIFY THE PROGRAM (INCLUDING, WITHOUT LIMITATION, WHAT THE REWARDS ARE, HOW YOU EARN THEM, THE DURATION OF THE PROGRAM) AT ANY TIME IN UBER’S SOLE DISCRETION.
You understand that all federal, provincial, and municipal taxes on the Rewards that you accept are your sole responsibility as the Reward recipient, and all Rewards are inclusive of any applicable taxes.
ELIGIBILITY
All participants in the Program are “Program Members.” In order to participate in the Program, you must (1) reside in Canada, (2) meet all eligibility requirements to be a driver with Uber (a “Driver”) as set by applicable law and Uber; (3) have a Driver account (excluding Uber Taxi accounts) in good standing; and (4) have set your home city within Uber Driver App as one of the following participating cities (each, a “Participating City”):
Alberta: Calgary, Edmonton, Lethbridge, Red Deer; British Columbia: Vancouver; Ontario: Hamilton, Kingston, Kitchener-Waterloo, London, Niagara, Ottawa, Toronto, Windsor; Quebec: Gatineau, Montreal, Quebec City,Sherbrooke, Saguenay, Trois-Rivieres, Laurentides, Rest of Quebec; Nova Scotia: Halifax; Manitoba: Winnipeg; Saskatchewan: Regina, Saskatoon. Once you are enrolled in the Program, there is no additional action required to participate in the Program.
Your rewards program account (“Program Account”) will automatically be linked to your Driver account. You may not share your Program Account or have multiple memberships.
HOW YOUR TIER IS DETERMINED
You must earn points (“Points”) to access the different Tiers (defined below) and the rewards offered in each Tier. You will earn 1 Point for every trip you complete as a Driver in the following views: UberX, UberXL, UberPremier, UberWAV, UberBlack, and UberSUV, in Canada. Each such trip, together with any trip with Uber Eats, shall count as a “Pro Trip” for the purposes of this Program. You will earn an additional amount of Points (for a total of 3 Points) when you either a) pick up a rider and commence a trip or b) complete a trip (or delivery) during the following times (displayed in the local time zone) (“Additional Point Hours”):
You earn Points in fixed three month periods: (i) August 1 - October 31; (ii) November 1 - January 31; (iii) February 1 - April 30; (iv) May 1 - July 31 (each, a “Program Period”).
Points expire and reset to zero at the end of every Program Period. They do not carry over to the next Program Period. Points will count in the Program Period in which Uber processes the point (which may be the next Program Period). You will not earn any Points for taking rides as a rider or orders you submit with Uber Eats. Points have no cash value and are used solely to determine your Program Tier. Points may be revoked if a ride or delivery, for which Points were earned, is refunded or if Uber believes, in its sole discretion, that Points were earned through or in connection with any fraud, abuse of the platform, or in violation of the Terms and Conditions, the general Privacy Policy, and your Uber Platform Access Agreement, including the Community Guidelines.
If you are a Driver that meets all the eligibility requirements set forth here, and you also deliver with Uber Eats (each independent provider of delivery services with Uber Eats, a “Delivery Person”), you will earn 1 Point for each delivery with Uber Eats you complete in a Participating City, in addition to any trips you complete as a Driver. For eligible Delivery Persons, you will earn additional Points (for a total of 3 Points) when you a) pick up a delivery or b) drop off and complete a delivery during the Additional Point Hours. For clarity, if you are only a Delivery Person and do NOT have an active Driver account, you are not eligible to participate in the Program and cannot earn any rewards.
A Program Member’s Tier status shall be determined by: 1) the Points earned in the previous Period and Points earned in the current Period; 2) Cancellation Rate (calculated on a rolling thirty (30) day basis) 3) Star Rating average over the past 500 trips. If a Program Member has completed less than 500 trips, the Star Rating is based on the average Star Rating of all lifetime trips.
PROGRAM TIERS AND WINDOWS
The Program offers four membership status Tiers: Blue, Gold, Platinum, Diamond (“Tiers”). Tiers unlock access to certain rewards (“Rewards”) offered by Uber and/or third parties. Each successive Tier includes its own Rewards as well as the Rewards of the preceding Tiers.
The Points you earn in one Program Period will determine your Tier in the next Program Period. Tiers are not permanent and must be earned for every Program Period. The Points required to determine your Tier in the next Program Period may be subject to change. You will be notified prior to the start of the next Program Period. IN ADDITION TO THE POINTS THRESHOLD OUTLINED BELOW, YOU MUST ALSO HAVE AT (1) LEAST A 4.85 DRIVER STAR RATING AND (2) NO GREATER THAN 5% CANCELLATION RATE IN ORDER TO REACH THE NEXT TIER.
You can move to a higher Tier during the current Program Period if you meet the Points and rating requirements described above. In that case, you will automatically be moved to the next Tier and you will stay in that Tier for the current Program Period and the next Program Period. For example, if you are a Driver in Ottawa and earn your 300th Point and have the required rating (4.85 or greater), and a cancellation rate (5% or less) in Program Period (on September 1), you will have earned the Gold Tier for the remainder of Program Period and for the entire next Program Period (until January 31), provided you maintain all GPD Characteristics during Program Period (see “Maintaining Your Tier” below).
Once you obtain a higher Tier, you may be able to immediately access some Rewards for the higher Tier, but not all Rewards may be available immediately. Some Rewards, including Faster Pickups at Select Airports and Trip Duration and Trip Direction, may require you to go offline and back online within the Uber Driver App for the Reward to apply to your next trip.
MAINTAINING YOUR TIER
In order to maintain your Gold, Platinum or Diamond Tier status during the entire applicable Program Period, you must maintain, at all times (1) a minimum Star Rating of 4.75 and (2) a maximum cancellation rate of 10% (collectively, the “GPD Characteristics”).
If you fail to meet any of the GPD Characteristics, you will lose your Tier status and access to the corresponding Rewards until you reach a minimum Star Rating of 4.85 and a cancellation rate of 5% or lower again. If you fail to meet any of the GPD Characteristics, you will maintain access to the Blue Tier and the corresponding Rewards as long as you remain in the Uber Pro program.
HOW TO VIEW POINTS BALANCES
You can view your current Points balances within the settings of the Uber App. Any errors or omissions on transactions posted to your Program Account must be reported within one month by contacting Uber as noted in the Contact Us section below. Failure to supply necessary documentation may result in an inability to award Points. For verification, you should retain all receipts and documentation until your Points are credited to your Program Account.
It may take approximately 72 hours for your cancellation rate to refresh. In the event of an outage of the Uber systems, your Points may be delayed in displaying in your Program Account. Additionally, if the outage occurs near the end of a Program Period, it is possible the Points will not be applied until the next Program Period.
ACCOUNT TERMINATION
Participation in the Program is a privilege granted to the Driver, and as such can be suspended, revoked, or terminated at any time by Uber for any reason. If your Program membership is terminated, all Points associated with your Program Membership and any Rewards may be forfeited immediately upon termination, in accordance with the terms of the specific Reward, as detailed below. If your Program membership is terminated due to fraudulent activity or noncompliance with these Program Terms, in addition to forfeiting all Points and Rewards associated with your Program Membership immediately, you cannot participate in or rejoin the Program.
PROGRAM CHANGES AND PROGRAM TERMINATION
We reserve the right to change or terminate the Program, or any part thereof, at any time without notice and without further obligations to you or any other Program Members, including, but not limited to modifications which: a) govern how Points are earned on and after the date of change; b) change the number of Points required to access a Tier; c) change the specific Rewards provided in each Tier; or d) change any other requirements necessary to obtain Rewards within a Tier. No Points will be earned after the effective date of termination. Any and all changes and/or amendments to these Program Terms will become binding upon all members immediately.
TRANSFER OF RIGHTS
Uber’s rights and obligations under the Program may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
INTERPRETATION OF PROGRAM TERMS
All interpretations of these Program Terms will be at Uber’s sole discretion and Uber’s decisions will be final.

The Program and/or any of its features may be unavailable, inaccurate, or interrupted from time to time for a variety of reasons outside of our control. We are not responsible for any unavailability, interruptions, or errors of the Program, its features or any Rewards. We may modify, suspend, or discontinue the Program or any feature at any time without notice. The Program and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. We, our affiliated entities and third party Rewards providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
IMPORTANT: PLEASE READ THE FOLLOWING ARBITRATION REQUIREMENT CAREFULLY. YOU WILL HAVE TO RESOLVE DISPUTES THROUGH ARBITRATION. YOU WILL NOT BE ELIGIBLE TO GET MONEY OR OTHER RELIEF THROUGH A COURT PROCEEDING.
ARBITRATION REQUIREMENT
You are free to get advice or representation from a lawyer about the arbitration requirement.
Unless prohibited by law, all disputes arising out of or relating in any way to the Program Terms will be finally and conclusively adjudicated and resolved by arbitration under the Arbitration Rules (“ADRIC Rules”) of the ADR Institute of Canada, Inc. (“ADRIC”), except as modified here. The arbitration will be in English or French as you choose. The arbitration may be held anywhere the arbitrator considers appropriate, including remotely by telephone or Internet.
The ADRIC Rules are available by, for example, searching <www.google.ca> to locate “ADRIC Arbitration Rules” or by clicking here. You can also contact ADRIC at 1-877-475-4353 or <www.adric.ca>.
You will have to pay some fees to arbitrate, as described in the ADRIC Rules.
However, before beginning the arbitration, the party with the claim will first try to informally negotiate with the other party, in good faith, a resolution of the dispute for not less than 30 days but no more than 45 days unless extended by agreement. During the negotiation period, any otherwise applicable limitation period will be tolled (temporarily suspended).
Nothing here prevents you from filing a claim with a government agency.
This arbitration requirement survives: (i) the termination of this Program; and (ii) the bankruptcy of any party. If any part of it is deemed invalid or unenforceable, the other parts remain in force.
The Program Terms are governed by and construed in accordance with the laws of Ontario, Canada, excluding its rules on conflicts of laws.
REWARDS DETAILS AND ADDITIONAL TERMS
Rewards are privileges granted to you. Rewards are granted at the discretion of Uber, may change or be canceled at any time, are not redeemable for Points and have no cash value. Reward details, terms and limitations may be found below. Rewards provided by third parties may require additional action by you, including, without limitation, agreeing to additional terms or creating an account with such third party. Drivers are responsible for all taxes that may be owed in the receipt of Rewards. Uber is not responsible for the products or services offered by third parties.
To ensure the success of the Program, Uber may collect information on such third party Rewards-based transactions for information and reporting purposes, in each case pursuant to the terms agreed to by the third party Reward provider and the Program Member.
THE FOLLOWING LIST INCLUDES DETAILS ON THE CURRENT OFFERS IN THE UBER PRO PROGRAM, PROVIDED BY PARTICIPATING PARTNERS OR UBER. PLEASE NOTE THAT OFFERS FROM EXTERNAL PARTICIPATING PARTNERS, INCLUDING BUT NOT LIMITED TO THE QUALIFICATIONS FOR ACCESSING THE REWARDS, AS WELL AS THE IDENTITIES OF THE PARTNERS THEMSELVES, ARE SUBJECT TO CHANGE AT ANY TIME IN UBER’S DISCRETION.
Priority Airport Rematch
Who is Eligible: In Hamilton, Ottawa, Toronto, Montreal, Quebec City, Saskatoon, Halifax, Winnipeg, Vancouver, and Calgary: Drivers in the Diamond tier.
This Reward is subject to availability at a given airport, which may change at any time without notice. If available, a qualifying Program Member may get prioritized for a potentially faster pickup at the airport.
Trip Duration and Trip Direction
Who is Eligible: In Ottawa and Toronto: Drivers in the Gold, Platinum, or Diamond tier who maintain a trip acceptance rate of 85% or higher (calculated on a rolling thirty (30) day basis). Drivers in the Blue Tier are not eligible for this Reward.
In Montreal and Vancouver: Drivers in the Platinum or Diamond tier who maintain a trip acceptance rate of 80% or higher (calculated on a rolling thirty (30) day basis). Drivers in the Blue and Gold Tier are not eligible for this Reward.
In all cities other than Ottawa, Toronto, Montreal, and Vancouver: Drivers in the Platinum or Diamond tier who maintain a trip acceptance rate of 85% or higher (calculated on a rolling thirty (30) day basis). Drivers in the Blue and Gold Tier are not eligible for this Reward.
This Reward applies to all trips on the Uber Driver App (in Uber’s sole discretion) but does not apply to deliveries with Uber Eats. A qualifying Program Member may be able to view duration and direction on the dispatch screen.
Priority Support
Who is Eligible: Drivers in the Gold, Platinum, and Diamond Tiers.
This Reward is subject to availability, which may change at any time without notice. If available, a qualifying Program Member may get prioritized for support.
Extra Destination
Who is Eligible: Drivers in the Gold, Platinum and Diamond Tiers.
This Reward is subject to availability, which may change at any time without notice. If available, after completing a qualifying long trip. a qualifying Program Member may get one (1) additional destination which the Program Member can use to return to an area set by the Program Member. This additional destination must be used within fifteen (15) minutes of receiving the notification.
Area Preferences
Who is Eligible: Drivers who have achieved either Platinum or Diamond loyalty status. Area Preferences is only available in certain participating locations, which are subject to change at Uber’s sole discretion without notice.*
Details: Area Preferences is a perk that enables drivers to select areas in their city that they would like to drive in. Drivers will only receive trip requests where the pick-up and drop-off destinations are within the boundaries of the areas they have selected within the Driver App. Feature is redeemable for up to 2 hours per day. While using Area Preferences, drivers will not receive airport pick-up requests. In order to be added to Airport queues, drivers must first have Area Preferences turned off and be located at a staging lot. Area Preferences will only filter rideshare trips (e.g., UberX, UberX Share, Black, etc.) by origin and destination. Area Preferences is not compatible with deliveries using Uber Eats.
*Area Preferences is only available in the following markets: Toronto, Vancouver, Montreal, Calgary, Ottawa, Halifax, Hamilton, London Ontario, Edmonton, Kitchener-Waterloo, Quebec City, Niagara Region, Windsor, Saskatoon, Regina, Gatineau.
Zero Emissions Vehicle Incentive
Who is Eligible: Drivers in the Diamond and Platinum tiers excluding drivers enabled to take trips with Uber Black, Uber Black SUV, or Uber Taxi.
This Reward will be available from February 1, 2023, to January 31, 2025, on rideshare trips and not on delivery trips, but including trips with Uber Connect. The offer period is divided into two 12-month periods: (i) February 1, 2023–January 31, 2024, and (ii) February 1, 2024–January 31, 2025. During each of the 12-month periods, qualifying drivers can get (a) $1 incentive per completed rideshare trip provided with a battery electric vehicle (BEV) up to a maximum of $4,000 in the 12-month period, and (b) $250 for the first 1,000 rideshare trips with a BEV completed within a 3-month Uber Pro Program Period, payable after the end of the Program Period, to a maximum of $1,000 in the 12-month period. This incentive may be reflected as a reduction of the service fee charged to you by Uber. Uber reserves the right to withhold or deduct the incentive in the event of error, suspected fraud, illegality, or violation of driver terms or these terms.
Intuit: Tax Preparation Services
Who is Eligible: All qualifying Program Members are eligible for this Reward. In some cases, this Reward may also require acceptance to additional terms and conditions of Intuit or its affiliates.
This Reward includes variable discounts for certain TurboTax Self-Employed and QuickBooks Self-Employed products. These discounts vary by Uber Pro Tier and may change from time to time. TurboTax Full-Service Self-Employed QuickBooks Self-Employed products are not available in Quebec.
CarAdvise: Car Maintenance Services
Who is Eligible: All qualifying Program Members are eligible for this Reward as long as they have signed up for CarAdvise (terms here) via their Driver Partner account. This Reward will also require payment of a membership fee and may require acceptance of additional terms and conditions of Car Advise or its third party suppliers.
This Reward is subject to availability, which may change at any time without notice. If available, CarAdvise membership provides discounted pricing (up to 15% on average) on certain car maintenance services, displayed within the CarAdvise platform, based off of regular retail pricing, which is subject to change without notice and varies by location. Prices displayed in the CarAdvise platform are also subject to applicable provincial and local taxes. Depending on your selected service, CarAdvise will provide a retail price, which is an example of what you can reasonably expect to pay for that service in your geographic area. CarAdvise (and Uber) makes no guarantee as to a specific savings amount per transaction.
Details: The CarAdvise platform enables members to select services and compare prices at select nearby car maintenance facilities. CarAdvise members can book car maintenance services via the CarAdvise platform. CarAdvise and Uber make no guarantee as to a specific savings amount per transaction, and prices shown in the CarAdvise platform are subject to change, variation by location, and may be subject to taxes.
For Platinum Tier, qualifying drivers will receive an additional 20% off of eligible oil changes. Promotion will automatically apply at checkout through the CarAdvise platform.
For Diamond Tier, qualifying drivers will receive an additional 40% off of eligible oil changes. Promotion will automatically apply at checkout through the CarAdvise platform.
Rosetta Stone
Who is Eligible: All qualifying Program Members in the Gold, Platinum, or Diamond tiers. To redeem the Reward, Program Members must sign up for Rosetta Stone. Additional terms may apply; see Rosetta Stone terms on their website.
Red Wireless - authorized Rogers dealer
Who is Eligible: All qualifying Program Members are eligible for this Reward. In some cases, this Reward may also require acceptance to additional terms and conditions of Rogers or its affiliates. Other conditions may apply. See Red Wireless page for more details.
This Reward includes variable discounts for wireless service. These discounts vary by Uber Pro Tier and may change from time to time.
